RETURN POLICY OF NETTIE’S NAH JOKE HOT PEPPERSAUCE INC.

This Return Policy is in accordance with the Terms and Conditions of this website (the “Website”) maintained by Nettie’s Nah Joke Hot Peppersauce Inc. (the “Company”).

At the end of the day we want you to be happy and try some excellent gourmet hot sauces, and back that up with a 100% guarantee. We will do what it takes to make the situation right, including replace or refund if needed. Throughout the Website, the terms “we”, “us” and “our” refers to the Company. Except where stated otherwise, the term the “Company” used in the Terms and Conditions includes Nettie’s Nah Joke Hot Peppersauce Inc., its licensees and their respective officers, directors, employees, suppliers, agents, affiliates, subsidiaries, successors and assigns.

Your access and use of the Website, including purchasing products (the “Goods/Products”) through our Website, indicates that you have read, understand and agree to be bound by the Return Policy set out below (collectively, called the “Return Policy”) and any other applicable laws, statutes and/or regulations. We may change these Return Policy at any time without notice, effective upon its posting to the Website. Your continued use of the Website will be considered your acceptance to the revised Return Policy.

1. Returning Goods/Products to the Company

(a) If there is an issue with the Goods/Products received, you agree to:

(i) Notify the Company via email within ten (10) business days of receiving the goods/product; and

(ii) Provide any information, including pictures of the goods/products received, as requested by the Company.v (b) We reserve the right to determine whether a full or partial refund, credit, replacement product, or any other resolution is appropriate on a case-by-case basis.

(c) Upon approval by the Company that you can return the Goods/Products, the Company will send you a shipping label, which you must use to ship the goods/products within ten (10) business days of receiving the shipping label.

(d) All Goods/Products returned by you to the Company must be the original Goods/Products as delivered to you, in their original, unopened packaging and must not have been used, with the exception of Goods/Products which have been discovered by you to be defective with notice to the Company.

(e) Under no circumstances will the Company authorize or accept returns of Goods/Products that were not purchased at or cannot be proven by you to have been purchased from the Website.

(f) The Company will not accept returns for Goods/Products, whether in good condition or defective, which have been tampered with, modified, or replaced with counterfeit or other products, as determined by the Company in its sole discretion.

(g) In the case that the returned Goods/Products are determined by the Company to have been tampered with, modified, or replaced with counterfeit or other products, the Company will not provide you with a refund.

(h) The Company cannot accept returns of products missing the serial number or UPC. The Company will not issue refunds for such items.

(i) A breach or violation of any of the terms in the Terms and Conditions will result in an immediate termination of your services and/or account.

(j) The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

(a) The Company will bear shipping and handling charges, if any, for Goods/Products that are defective or where wrong Goods/Products were received.

(b) In the case where the Company has determined that the Goods/Products are defective or where wrong Goods/Products were received by you, the Company will bear the shipping and handling charges for re-shipping the correct goods/products.

(a) You must follow the procedures for initiating a return of defective Goods/Products as described in the Company’s Terms and Conditions and Return Policy.

(b) Upon the Company’s validation that the Goods/Products are defective, the Company will refund the total purchase price in the original payment method tendered.

(c) Failure to comply with the return procedure outlined in this Return Policy will result in the Goods/Products being rejected and no refund being issued by the Company.

(d) All goods/products returned by you to the Company must be the original goods/product as delivered to you, in their original, unopened packaging and must not have been used, with the exception of goods/products which have been discovered by you to be defective with notice to the Company.

(a) If the Company determines a refund is appropriate in the circumstances, the Company will send an email to you when the Goods/Products have been received and processed.

(b) You will receive the refund in the same form of payment tendered for purchase within thirty (30) business days from the day the Company approves the return.

(a) The Company will not accept returns for items which fall into the following categories:

(i) Goods/Products that cannot be returned for hygienic reasons (such as, but not limited to, any returnable Goods/Products that the Comapny determines in its sole discretion has been removed from its original packaging);

(ii) Goods/Products that have been personalized, imprinted or made specifically for you;

(iii) Goods/Products that have already been used by the you or their agent, in whole or in part;

(iv) Goods/Products that may expire based on the nature of those Goods/Products; and

(v) Goods/Products that are sold during clearance sales or events. The Prices, materials, and information contained on the Website are subject to change without notice and may vary from those prices charged through other websites offering the Company’s goods/products and from location to location.

(a) You must ship the Goods/Products using the return label provided by the Company to ensure the product is returned safely and in the same condition in which it was sold to you.

(a) The Company has the right to determine in its sole discretion, whether or not the Goods/Products can be returned and retains the discretion to provide a full or partial refund, credit, replacement product for the Goods/Product on a case-by-case basis.
